1. Getting Started
Welcome! This Terms of Service ("Terms", this "Agreement") constitute a legally binding agreement between you ("User," "you," or "your") and Storm AI LLC ("Storm", "we," "us," or "our").
1.1 Scope of Agreement
This Agreement governs your access to and use of (i) our website and all subdomains, (ii) all related forms and landing pages, and (iii) any content, features, products, or services we provide (collectively, the "Services").
1.2 Your Acceptance
You represent and warrant that (i) you are of legal age in your jurisdiction; (ii) your access to and use of our Services complies with all applicable laws; and (iii) you have the legal capacity to enter into this agreement.
By accessing or using our Services, you acknowledge that you have read, understood, and agree to be bound by this Agreement. If you do not agree, you must immediately discontinue use of our Services.
2. Access and Use Rights
2.1 License Grants
We grant you a limited, non-exclusive, non-transferable, revocable license to access and use the Services for personal, non-commercial purposes in accordance with this Agreement. By submitting content to our Services, you grant us a license to use, store, and process such content as necessary to provide our Services. By providing us with any suggestions or ideas ("Feedback"), you grant us an irrevocable, worldwide license to use such Feedback without compensation to you.
2.2 License Restrictions
You may not: (i) modify, reverse engineer, or create derivative works of our Services; (ii) harm, interfere with, or scrape data from our Services; (iii) access or use our Services for non-personal purposes or otherwise commercially exploit our Services; (iv) gain competitive intelligence or build competing services using our Services; (v) infringe on our or third party intellectual property rights using our Services; (vi) remove, alter, or obscure any proprietary rights notices in our Services; or (vii) violate any laws or engage in fraudulent or deceptive activities using our Services.
3. Intellectual Property Rights
We retain all rights, title, and interest in and to (i) our Services and any underlying technology and intellectual property; (ii) any content, materials, and features provided through our Services; (iii) our trademarks, logos, and brand elements; and (iv) any improvements or modifications to our Services, including any Feedback.
4. Limitations and Disclaimers
OUR SERVICES ARE PROVIDED TO YOU "AS IS," "AS AVAILABLE," AND "WITH ALL FAULTS." WE MAKE NO WARRANTIES, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO: MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, ACCURACY OR RELIABILITY OF CONTENT, UNINTERRUPTED OR ERROR-FREE OPERATION, OR FREEDOM FROM VIRUSES OR HARMFUL COMPONENTS.
We shall not be liable for failures caused by circumstances beyond our reasonable control, including but not limited to acts of God, natural disasters, war, terrorism, riots, embargoes, acts of civil or military authorities, fire, floods, pandemics, or strikes.
Our Services may contain links to or integrations with third-party websites or services. We do not endorse, control, or assume responsibility for any third-party content or services. Your interactions with third-party services are solely between you and the third party. We recommend reviewing their terms of service and privacy policies before use.
Content provided through our Services is for informational purposes only and should not be construed as professional advice.
5. Liability and Claims
TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE SHALL NOT BE LIABLE FOR: (I) INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, (II) LOST PROFITS, REVENUE, OR DATA, (III) BUSINESS INTERRUPTION, OR (IV) COST OF SUBSTITUTE SERVICES. IN NO EVENT SHALL OUR TOTAL LIABILITY EXCEED THE AMOUNT YOU PAID US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.
You agree to defend, indemnify, and hold harmless Storm AI LLC, its affiliates, and their respective officers, directors, employees, and agents from any claims, damages, losses, and expenses (including reasonable attorneys' fees) arising from any of: (i) your access to, use or misuse of our Services, (ii) your violation of this Agreement, (iii) your violation of any applicable laws or third-party rights, (iv) any content you submit through our Services, or (v) your negligence or willful misconduct.
6. Account Actions and Termination
If we believe you have breached this Agreement, we may (i) issue a warning, (ii) temporarily or permanently suspend your access, (iii) take legal action to recover damages and costs, or (iv) report illegal activities to law enforcement. These actions are not exhaustive – we reserve the right to take any action we deem appropriate.
You may stop using our Services at any time. We may terminate or suspend your access to our Services immediately, without prior notice, for any reason, including breach of these Terms.
Upon termination: (i) your license to our Services ends immediately, (ii) you must cease all access to and use of our Services, and (iii) any Terms provisions that by their nature should survive termination will remain in effect.
7. General Terms
7.1 Service and Terms Changes
We reserve the right to modify, suspend, or discontinue any aspect of our Services at any time without notice.
We may update these Terms periodically. Continued use of our Services after changes constitutes acceptance of the updated Terms.
7.2 Dispute Governance
These Terms are governed by the laws of Georgia, without regard to conflict of law principles. The courts of Georgia shall have exclusive jurisdiction over any disputes arising from these Terms, except that we may pursue collection actions in your jurisdiction.
If any provision is found unenforceable, the remaining provisions shall continue in full effect. Our failure to enforce any provision shall not constitute a waiver of that provision.
7.3 Assignment
You may not assign your rights under these Terms. We may assign our rights without restriction.
7.4 Relationship
Nothing in these Terms creates a partnership, joint venture, agency, or employment relationship between us.
7.5 Entire Agreement
